1. INTRODUCTION

1.1. This User Agreement, hereinafter referred to as TERMS, TERMS or TERMS OF USE, governs the relationship between SELETO BANK PAGAMENTOS S/A, a provider of online payment services OR, correspondents, organized in accordance with the laws of the Republic of Brazil , duly registered with the CNPJ/MF under No. 34.049.840/0001-60, granted by the Federal Revenue Service of Brazil, hereinafter referred to as SELETO BANK, PLATFORM or PLATFORM, NÓS or NOSSA; and customers willing to make use of the services of SELETO BANK, hereinafter referred to as CLIENT, CONSUMER, YOU or YOURS.

 

1.2. Parts. This contract represents a contract between the CLIENT and the PLATFORM, as well as, when applicable, between the CLIENT and other service providers integrated to SELETO BANK. Denying or failing to comply with one or more conditions in the TERMS may lead to the termination of the CLIENT's SELETO BANK account and, if applicable, additional legal complications, pursuant to the law.

 

1.2.1. Applicable law. You agree that the laws of the Republic of Brazil, without respecting the principles of conflicting laws, govern the current agreement between the two parties and shall regulate any claim or dispute that may arise from the business relationship that this document covers.

 

1.3. This agreement is non-transferable. Any attempt to transfer this agreement will be void and violate the current terms.

 

1.4. SELETO BANK reserves the right to modify, at any time, these TERMS, without prior notice. Your continued use of the PLATFORM is subject to the most up-to-date TERMS, which are always available on the SELETO BANK website and can also be requested by email to <legal@seletobank.com.br>.

 

1.5. If you are registering on behalf of an organization, this is confirming that you have legal authority to accept agreements on behalf of your organization.

 

1.6. If the CUSTOMER does not agree with one or more of the terms or conditions in these TERMS or PRIVACY POLICY, the CUSTOMER will not have the right to sign up for a SELETO BANK account and will not use any service provided by SELETO BANK.

 

1.7. CUSTOMER ACKNOWLEDGES THE IMPORTANCE OF THE TERMS PRESENTED HEREIN AND HAS CONSIDERED EACH TERM CAREFULLY WHEN BECOME A MEMBER OF THE SERVICE. THIS DOCUMENT CONTAINS PROVISIONS THAT DEFINE THE POSSIBILITIES AND LIMITATIONS FOR CLAIMS THAT THE PLATFORM AND CUSTOMER MAY HAVE. SELETO BANK'S LIABILITY TO THE CUSTOMER HAS LIMITATIONS IMPOSED BY THIS AGREEMENT.

 

 

2. COMMITMENT THAT THE CUSTOMER MAKES TO US

You confirm and warrant to us that the following statements are and will remain true while you are a SELECT BANK user:

 

2.1. VYou are at least 18 years old.

 

2.2. You are able to agree to the current terms.

 

ANNOUNCEMENTS

 

2.2.1. You agree to receive and read all official communications issued by SELETO BANK, including, but not limited to:

  • Receipts or rejections of transactions;

  • Changes related to these TERMS, PRIVACY POLICY or any other official document;

  • Changes regarding the PLATFORM and maintenance information;

  • Requesting information about you and/or your account.

 

2.2.2. You agree to respond, when possible, to these communications.

 

2.2.3. You agree to keep your primary email updated (this setting is available on your account page) and to check your spam folder for false positives that may have classified official SELETO BANK communications as illegitimate.

 

2.2.4. You will check that the information received is officially published by SELETO BANK, and not a third party trying to impersonate SELETO BANK.

  • Your email address must be your primary email address registered with SELETO BANK;

  • The email must not have links to domains or subdomains outside SELETO BANK (see 2.8.4) requesting your private information;

  • Relevant issues for public disclosure should also be available in our press room, available at <https://noticia.seletobank.com.br>;

  • You can always send an email to suporte@seletobank.com.br  if you want to verify its origin.

 

2.2.5. You may, at any time and free of charge, request another electronic copy of any communication, in case of accidental loss, by sending an email to <support@seletobank.com.br>.

2.3. The law of the jurisdiction where you reside permits you to make use of all SELETO BANK services.

 

2.4. You are not involved and will not be involved in any Prohibited Business.

 

 PERSONAL DOCUMENTS AND PROOF OF LIFE

2.5. You will provide us with your official identity issued by your local government (ID card or driver's license) or a valid passport, and you agree to provide new documents as soon as the documents provided become invalid or reissued.

2.5.1. When requested, you will provide additional personal information and additional documents, including, but not limited to: legal name, address, date of birth, banking information, taxpayer identification number, proof of address, and personal pictures (“selfies”) .

 

2.5.2. You agree to provide us with face identification and tracking data, which will be used to protect YOU and THE PLATFORM.

 

2.5.3. You will also perform, where necessary, physical actions, for our automated living person verification system or via video call with an authorized agent.

 

2.5.4. You agree that your collected personal data may be shared with third parties, including but not limited to law enforcement agents and banks.

 

2.5.5. You agree to keep your contact information (emails and phone numbers) up to date and confirm ownership of any contact method upon request. This is done via a link or an instant token sent via email or SMS.

SANCTIONS

 

2.6. You agree to have your documents and personal data checked against sanctions lists such as the OFAC SDN List, the U.S. Department of Commerce Denied Persons List, the National Treasury Financial Sanctions Regime, and the Security Council Consolidated Sanctions List. of the United Nations daily.

 

2.7. You will not provide any products or services to a resident of jurisdictions subject to Brazilian or European Union embargoes.


SAFETY INFORMATION

2.8. You will not use your SELETO BANK account to carry out illegal activities against society, organizations or individuals. You will not access other users' SELETO BANK account, send communications (emails, SMS or any other form of communication) similar to SELETO BANK communications or may lead readers to believe that it is an official SELETO BANK communication.

 

2.8.1. You will not develop software, scripts, browser extensions or applications that steal other SELETO BANK accounts, funds, passwords, PIN codes or personal information from another person(s).

 

2.8.2. You will not do any kind of security testing like penetration testing, port scanning, S.I.G. (obtaining information from services) or exploiting vulnerabilities against any SELETO BANK server, without explicit authorization issued by SELETO BANK.

 

2.8.3. You will not do anything that could make SELETO BANK's services unavailable or different to one or more users, including, but not limited to, ARP poisoning, DNS spoofing, denial of service, or distributed denial of service.

 

2.8.4. If you find any vulnerability in our systems, you will immediately contact security@seletobank.com.br or bugbounty@seletobank.com.br, providing a proof of concept (“PoC”), using our network test environment ( accessible through https://testnet.seletobank.com.br) whenever possible and optionally joining our bug bounty program. You may not publicly disclose any details about such vulnerability prior to explicit authorization, nor may you attack any account of the principal instance of the service, even if only to demonstrate the discovered vulnerability.

 

2.8.5. You will not attempt to reverse any transaction sent to SELETO BANK. You will not charge such transactions to your bank or attempt double-spend attacks against SELETO BANK or any cryptocurrency supported by SELETO BANK.

 

2.8.6. You will help keep your SELETO BANK account secure, which involves tasks such as, but not limited to:

  • Use a secure and strong password;

  • Change your password regularly;

  • Do not keep your account logged into machines you are not using;

  • Do not make copies of your password, PIN code or credentials to your primary email address, or allow others to access this information.

  • Do not allow anyone to access your phone, even when locked, as your phone or SIM card can be used to reset your password and/or PIN code;

  • Keep your machine safe with decent antivirus software and up-to-date firewall;

  • Avoid fake pages, always checking if the page that claims to be from SELETO BANK is the main domain or a subdomain of “seletobank.com”, “seletobank.com.br” “seletobank.net ", "seletobank.io" or "seletobank .al". To verify that you are on one of these domains, make sure that the URL you are on has nothing or a slash (“/“) followed by the URI path after one of the mentioned domains; Not to provide secret information or account credentials to anyone, by email, SMS, phone call or any other means, even those claiming to be from SELETO BANK. Our agents have enough information to support our internal applications, and no account information should be requested from the user;

  • Avoid entering your credentials (especially your PIN code) on public networks or machines, such as cyber cafes, businesses, airports, restaurants or hotel chains;

  • Make sure your two-factor authentication backup codes are securely stored;

  • Enable two-factor authentication;

  • Do not paste any code into the developer console or your browser's navigation bar.

  • Avoid clicking on unknown links or downloading unknown attachments, even those from known sources;

  • Do not pass on login codes or session identifiers to anyone.

 

2.8.7. You are fully responsible for the status of your account, credentials and access to it.

 

2.8.8. You are fully responsible for all transactions carried out on behalf of your account. You alone are responsible for any migration or loss of funds, including resulting from authorized access. SELETO BANK is not responsible for losses due to accounts with compromised security.

2.9. You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to access and use SELETO BANK servers, including our APIs. You agree that you have no rights beyond the limits of this license.

2.9.1. You will not copy, transmit, distribute, sell, resell, re-license, decompile, intercept, reverse engineer, disassemble, modify, correct, publish, participate in the creation, transfer or sale of, create derivative works from, perform, display, embed on another website (except through the API), or otherwise exploit the content of SELETO BANK services, in part or as a whole.

2.9.2. You will not frame, display, Stream or transmit any part of the SERVICE or our trademarks without prior explicit permission which may be requested by email at legal@seletobank.com.br.

 

2.9.3. Authorized transmissions of our trademarks are governed by our trademark standards, which can be requested, after obtaining explicit permissions, by sending an email to legal@seletobank.com.br.

 

SINGULARITIES OF ACCOUNTS

2.9.4. You agree that you will only maintain one account with SELETO BANK. You may request the right to have an additional account by sending an email to suporte@seletobank.com.br in order to obtain written permission from SELETO BANK to maintain this second account, but we are under no obligation to approve any account. adjacent.

 

2.9.5. Having multiple accounts without authorization from SELETO BANK can lead to the closure of the accounts involved.

 

2.9.6. A SELETO BANK account is not subject to transfer to any person or organization.

 


ACCOUNT AVAILABILITY

2.10. You confirm that you have or have access to the minimum hardware and software configuration necessary to access your SELETO BANK account, which is currently, but may change in the future:

  • A functioning computer, with an operating system installed and working properly;

  • A broadband internet connection;

  • An up-to-date web browser, such as Google Chrome or Mozilla Firefox, with cookies and JavaScript enabled;

  • A valid email address;

  • Sufficient storage space for cookies and cached information (at least 20 megabytes, 50 megabytes recommended);

  • and also, but optionally: A smartphone running recent versions of Android or iOS, to run the SELETO BANK Mobile App.

 

 

3. PLATFORM PROVISIONS

 

3.1. SELETO BANK provides the CLIENT with a SELETO BANK ACCOUNT, which is a personal area with functions based on the user's personal data.

3.1.1. A SELECT BANK ACCOUNT holds different forms of funds, such as cryptocurrencies, precious metals or internal tokens, which can be exchanged to and from cryptocurrencies and fiat-backed tokens within the PLATFORM.

3.1.1.1. SELETO BANK reserves the obligation to carry out the necessary KYC/AML checks ("know your customer" and "anti-money laundering"), provide user support and carry out the necessary due diligence and partnerships for the custody of funds in fiat currencies.


ASSETS AS TOKENS

3.1.2. PLATFORMA provides spaces in the form of “wallets”, hereinafter referred to as “SELETOWALLETS”.

3.1.3. SELETOWALLETS hold assets ("tokens") that are financially equivalent to the assets you place on the PLATFORM.

 

3.1.3.1. Your rights are solely in the value of the tokens you hold on the PLATFORM in any of the supported withdrawal methods for your jurisdiction.

 

3.1.4.The assets placed on the PLATFORM will be transferred to SELETO BANK or one of the corresponding authorized companies worldwide.

3.1.5. To place resources on the PLATFORM, you will receive the economic value of the assets in the form of tokens, on the SELECTOWALLET of your choice. The value of your tokens can be displayed, in real-time, in the supported virtual currency (hereinafter referred to as "CURRENCY") of your choice, and can also be exchanged, in part or entirely, for any other supported currency.

3.1.6. In the event that your account is found to be inactive (i.e., for not using the PLATFORM for more than 180 days or the time defined by your jurisdiction), SELETO BANK may be required to declare your funds as unclaimed property to the government of the jurisdiction in which that the account is registered.

3.1.6.1. Beforehand, SELETO BANK will try various methods to contact you, which includes, but is not limited to, sending an email, contacting you by phone or physical address. These attempts will occur a few days before the 90-day period that your account has not been granted access. If, however, no attempt succeeds, your withheld funds may be turned over to the jurisdiction.

3.1.6.2. An account may be marked as inactive if no access is recorded on it after 180 days (or the time defined by your jurisdiction). An access is considered using a previously created session or starting a new session.

3.1.6.3. If your account is closed, you can request that the remaining balance be sent by post. In this case, it will be sent to the address defined in your account settings.

 

3.1.6.4. If your funds have been blocked, in whole or in part, by law enforcement agencies, we will not be able to fulfill this request.

3.1.7. We rely on third parties to store part of the funds and provide the exchange services. As the entire cryptocurrency market is recent, some of these third parties do not have a long operating history and therefore their management is unproven. Since the cryptocurrency market and financial services history has some examples of loss of funds due to fraud, theft or other reasons, you accept the risk that one or more of these parties will not strictly comply with our agreements with them.

TRANSFERS AND EXCHANGE

 

3.2. You may transfer funds from one SELETOWALLET to another as long as the originating SELETOWALLET is owned by you or you reserve the rights to spend it. This act results in a TRANSACTION (a transaction subtracting the amount from the source wallet) and a COLLATERAL TRANSACTION (a transaction adding the amount to the destination wallet).

 

3.2.1. Moving funds between two SELETOWALLETs under the same ownership and holding the same currency is considered RELOCATION.

3.2.2. The movement of funds between two SELETOWALLETS under the same ownership, but which do not have the same currency, is considered CONVERSION.

3.2.3. Moving funds between two SELETOWALLETS of different owners is considered a TRANSFER, regardless of the currencies the two wallets operate in.

3.3. Transfers take place in a currency of your choice, regardless of the currency held by the source or destination wallet.

3.3.1. If the source wallet does not have the same currency as the transfer currency, a conversion will be performed.

 

3.3.2. If the destination wallet does not have the same currency as the transfer currency, a conversion will be performed.

 

3.4. Transactions are final and irreversible.

 

3.4.1. If, by dispute or court decision, a transaction has to be voided, this will be done through an INTERVENTION, that is, adding a movement in the wallets involved to void both the TRANSACTION and the COLLATERAL TRANSACTION.

 

3.4.2. If you believe you have accidentally made a transaction to the wrong recipient, our support agents cannot reverse it and are limited to providing an anonymous email address so that you can attempt to contact the wallet owner.

 

3.4.2.1. The response to the contact attempt is entirely up to the choice of the owner of the target account.

 

3.4.3. We are not responsible for resolving disputes or discarding any amounts due to chargeback claims. Use the PLATFORM at your own risk.

 

3.5. SELETO BANK reserves the right to charge or not charge a convenience fee for currency exchanges and the final amount debited is displayed before the action is taken. The fees and fees involved in using your account are available at https://exchange.seletobank.com.br.

 

3.5.1. We are not responsible for losses due to fluctuation in the prices of any currency.

 


COMPLETE ACCOUNT AND WITHDRAWAL

3.6. You can transfer funds from outside the PLATFORM to your account via supported cryptocurrencies or one of the supported fiat currency deposit methods.

 

3.6.1. We reserve the right to charge a fee for processing deposits.

 

3.6.2. We reserve the right to calculate the minimum blockchain confirmations for cryptocurrency deposits required to have the funds available in your account, based on the deposit transaction's risk score, which is based on a variety of factors including, but not limited to, whether to the cryptocurrency, wallet and at the origin value.

 

3.6.3. We reserve the right not to process deposits if:

  • It comes from crypto-wallets and bank accounts that are known to have been involved in illegal activities;

  • The transaction currency is not the one held by the target wallet.

 

3.6.3.1. In some jurisdictions, we are unable to accept bank transfers from third party bank accounts to your SELETO BANK account. In this case, you will be warned about this on the deposit pages. Given your insistence, we reserve the right not to process such a transaction.

3.6.3.2. Amounts whose deposit has not been processed can be claimed by email support@seletobank.com.

 

3.6.3.3. We reserve the right to charge a variable fee on the chargeback of unprocessed deposit transactions.

3.6.4. You confirm that you are allowed to use the financial instrument (e.g. bank account or cryptocurrency wallet) and authorize PLATFORM to receive the full deposit amount you designate.

 

3.6.4.1. You agree that we may collect such data (without credentials) for internal use and such data may be shared with law enforcement agencies in the event of suspected involvement in illegal activities.

 

3.6.5. We reserve the right not to process a deposit transaction due to regulatory or compliance reasons if we suspect that the transaction may involve funds originating from illicit activities, including, but not limited to, money laundering, terrorist financing, fraud or theft.

 

3.6.5.1. We are required, in that case, to close accounts that have exhibited such behavior, as well as to report our suspicions to the appropriate law enforcement agencies.

 

3.7.1. We reserve the right to store values ​​in offline warehouses. This is done as a security measure. For this reason, we may need to access stored assets offline. This can delay withdrawal operations.

 

3.7.1.1. In no way can we guarantee that a requested amount will be available for withdrawal from our online storage and therefore we cannot guarantee that a requested withdrawal will not be delayed.

 

3.7.1.2. We are not responsible for any issues caused by late transactions.

 

3.7.1.3. For the safety of PLATFORMA and its users, PLATFORMA has several mechanisms for real-time analysis of patterns and risks. These mechanisms identify suspected fraud transactions, which are reviewed by SELETO BANK agents. These analyzes may delay some transactions and withdrawals made on the PLATFORM.

 

3.7.2. We are not responsible for delays in transfers involving external services such as banks and wallet systems, regardless of the origin of the delay, which includes, but is not limited to, holidays or low mining fees.

 

3.7.3. We will not process transfers of any unsupported assets or assets that have been moved to crypto-wallets that do not hold their currency.

3.7.3.1. An unsupported currency is any and all currencies that are not in the PLATFORM's currency selector, visible, for example, when creating a new wallet.

 


ACCOUNT LIMITS

3.8. FWe make use of various calculation models and maintain a varying number of procedures and checks on you to keep our members, partners and ourselves out of fraudulent activity.

 

3.8.1. Your SELETO BANK account has designated limits based on your activity.

 

3.8.2. Your limits will be available once your account is confirmed, in accordance with our KYC/AML Policy (accessible at https://kycaml.seletobank.com.br).

 

3.8.3. Members who wish to increase the limits can make such a request by email to suporte@seletobank.com.br. We may require additional documents for due diligence.

 

3.8.3.1. We do not guarantee that a member will have higher limits, even after due diligence procedures.

 

4. SELECT BANK IS NOT A BANK

 

4.1. SELETO BANK is not a banking institution.

4.2. Saved funds do not earn interest, unless otherwise stated.

4.3. The balances are not insured by any insurance company, whether government or private.

5. INFORMATION SHARING

 

5.1. Under sustainable conditions, we do not share confidential user information.

 

5.1.1. We may share your information if required by law enforcement agencies.

5.1.1.1. Such disclosure is governed by our Privacy Policy.

5.2. We reserve the right to contact third parties, including, but not limited to, banking institutions, authorities, organizations and individuals and share with them details of any transaction, in the event of suspected illegal behavior.

5.2.1. We reserve the right to contact individuals or organizations that may also be involved in or victims of any possible illegal activity that we may encounter among SELETO BANK users, regardless of whether or not the affected parties are SELETO BANK users.

 


6. NON WAIVER OF RIGHTS

6.1. A possible prior failure on our part to take action with respect to suspected or misbehavior on the part of any user of SELETO BANK does not revoke our right to take action for subsequent cases, regardless of the similarity between the cases. This agreement does not allow the waiver of any rights to either party.

 


7. SELECTO BANK IS NOT A CONSULTANCY

7.1. SELETO BANK's services and communications are not intended to advise on any matter, including but not limited to investments, legal matters or taxes.

 

7.2. SELETO BANK does not provide tax advice. You are responsible for seeking information about any tax or legal implications that your use of our services may have.

 


8. RISKS INVOLVED IN THE USE OF CRYPTOCURRENCY

8.1. Cryptocurrencies tend to be more volatile than fiat currencies, precious metals and other assets. Price unpredictability can lead to huge losses in a short time.

 

8.2 Cryptocurrencies are not guaranteed by any government or institution and tend not to hold underlying assets.

 

8.3. The use of cryptocurrencies can be affected by government actions.

 

8.4. It is unclear how cryptocurrency prices are set, but it may derive from market movements regarding the buying and selling of crypto assets to and from fiat currencies. This creates the potential for permanent total loss of values ​​if the market for a particular cryptocurrency ceases to exist.

 

8.5. The irreversible nature of cryptocurrencies creates a field for online fraud schemes. We cannot reverse any cryptocurrency transactions and do not have access to ownership of any cryptocurrency wallet. Losses resulting from fraud or accidental transfers are likely to be irrecoverable.

 

8.6. You agree that any dispute between YOU and sellers of products or service providers shall be kept within this scope and shall not reach the scope of SELETO BANK.

 

 9. THIRD PARTY APPLICATIONS AND API USE

9.1. Our open API allows developers to build applications that run on SELETO BANK systems. SELETO BANK has no control over how these applications store their data and therefore SELETO BANK assumes no responsibility for the actions taken by these applications or their developers.

 

9.1.1. You must responsibly choose whether to give an application or website access to your SELETO BANK account and assume all risks associated with using such applications.

9.1.2. In case of dispute between you and the API developers, item 8.6 applies.

9.2. You may at any time revoke the permissions granted to third party applications from your account settings ("Apps").


10. NO WARRANTY, LIMITED LIABILITY


We make every effort to keep the service available, bug-free and secure, but you use it at your own risk.

WE CONCENTRATE EFFORTS TO KEEP THE SERVICE AVAILABLE, SECURE AND OPERATING PROPERLY, BUT USE OF THE SERVICE IS AT YOUR OWN RISK. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT ACCESS TO EACH PORTION OF THE SERVICE WILL BE CONTINUOUSLY, UNINTERRUPTED, ERROR-FREE OR COMPLETELY SECURE. SYSTEM OPERATION MAY BE INTERRUPTED BY NUMEROUS FACTORS WHICH ARE OUTSIDE OUR CONTROL. WE MAKE NO WARRANTIES REGARDING THE ACTUAL OR PERCEIVED VALUE OF ANY VIRTUAL CURRENCY OR TOKEN. THE PRICING OF VIRTUAL CURRENCIES IS UNPREDICTABLE, AS MUCH AS WE MAY OFFER HISTORICAL INFORMATION, AND WE WILL NOT TAKE ANY RESPONSIBILITY FOR ANY LOSSES YOU MAY OCCUR BY DEALING WITH VIRTUAL CURRENCIES, EVEN IF, FOR ANY REASON, THE LOSS WAS CAUSED BY A DELAY, SUSPENSION OR INTERRUPTION OF SERVICE. WE MAKE NO WARRANTY AS TO THE QUALITY, USEFULNESS, ACCURACY OR AVAILABILITY OF THE SERVICE. ​ WE ARE NOT IN ANY WAY RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION OR DATA PROVIDED BY THIRD PARTIES. DIRECTORS, EMPLOYEES AND AGENTS, AFFILIATES, PARTNERS, SERVICE PROVIDERS OR ANY OF THEIR DIRECTORS, DIRECTORS, EMPLOYEES OR REPRESENTATIVES, FROM ANY CLAIM AND DAMAGES IN ANY WAY RELATED TO ANY CLAIM AGAINST YOUR THIRD PARTIES. ​ WE WILL NOT BE LIABLE TO YOU FOR LOSS OR OTHER CONSEQUENTIAL, INDIRECT OR INCIDENTAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT. WE RESERVE THE RIGHT AT ANY TIME TO MODIFY OR DISCONTINUE, TEMPORARY OR PERMANENTLY, THE SERVICE (OR ANY PART THEREOF) WITH OR WITHOUT NOTICE. YOU AGREE THAT SELETO BANK SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY MODIFICATION, SUSPENSION OR DISCONTINUATION OF THE SERVICE. ​ SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, REPRESENTATIONS AND CONDITIONS OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. THEREFORE, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. TERMINATION OF ACCOUNT

11.1. If you want to stop using the PLATFORM, you can cancel your account. To do this, you must remove all funds from your account and send an email to suporte@seletobank.com.br informing you of your intentions to close your account.

11.1.1. You can request account reopening at any time by sending an email to suporte@seletobank.com.br. Your contact must be initiated by one of the emails added to your account, and you may be asked to provide additional information about yourself or your account in order for it to be reopened.

11.2. We may terminate, suspend or restrict your account if we suspect that you are involved in any illegal activity or in any of the Prohibited Businesses and Uses, for breach of these terms or for commercial disinterest in maintaining your account.

 

11.2.1. If your account is closed by the team, you may claim your funds following items 3.1.6.3 and 3.1.6.4.

 

12. MITIGATION AND COMPENSATION OF LOSSES

12.1. You are responsible for all claims, fees, fines, penalties and/or any other liability incurred by SELETO BANK, one or more of our corresponding companies or third parties, caused by or arising out of your breach of this document and/or or the your use of the PLATFORM.

 

12.2. You agree to reimburse SELETO BANK or a third party for any and all liability, fees and expenses incurred in the event that SELETO BANK shall enforce its rights.

 

12.3. You agree that if you incur one or more Prohibited Uses and Businesses and your use causes damage to the PLATFORM or one or more of its users, partners or third parties, an amount of damages compensation will be calculated, based on the proportions of the damage, and must be paid by you to SELETO BANK.

 


13. LEGAL VALIDITY AND CONFLICTS

13.1. If any term or condition of this document is found to be invalid by a court, such term or condition will be amended and replaced in order to fulfill the purposes of the original term to the greatest possible extent.

 

13.2. If any term or condition in this document conflicts with the laws of the jurisdictions in which SELETO BANK operates, the latter will prevail.

 

13.3. You agree that the Portuguese version of the service, this document and any other communication, legal document or page maintained by SELETO BANK will prevail in the event of conflict with any translation, summary or shared copy.

 

13.4. By registering and confirming your SELETO BANK account, you agree that you have read, fully understood and accepted all the terms and conditions of the current TERMS and PRIVACY POLICY. The most recent version of any of these terms is always available on the SELETO BANK website or can be requested by sending an email to legal@seletobank.com.br.
